These Terms of Use apply to your use of indiasbuy.com (the "website"), run by IndiasBuy ("we", "us"). By browsing the website, creating an account or placing an order, you agree to these terms. Purchases are also covered by our Terms of Service, and our Privacy Policy explains how we handle personal information. If you do not agree with these terms, please do not use the website.
Using the website
You may use the website to browse products, read information and place orders. You agree not to:
- use the website for anything unlawful or fraudulent, including placing false orders or using payment details without permission;
- try to gain unauthorised access to the website, other customers' accounts or our systems, or disrupt how the website works;
- upload harmful code, or use automated tools to copy content or overload the website; or
- pretend to be someone else or misrepresent your connection with any person or business.
If you are under 18, please use the website with the involvement of a parent or guardian.
Accounts
You can create an account to see your orders. Give accurate details and keep your sign-in details confidential; you are responsible for activity on your account. If you think someone else has used it, contact us straight away. We may suspend or close accounts used for fraud or misuse.
Product information
- A product's condition is stated in its title: "Unboxed" or "Openbox" for open-box units, and "Brand New" or "Fresh Pack" for new, sealed units. If you are unsure about a product's condition, ask us before ordering.
- Unboxed products are returned or display units in like-new condition, checked and cleaned before they are listed. The packaging may not be in mint condition. Unboxed is not the same as used or refurbished.
- Images and specifications come from product listings and manufacturer information. Colour, finish and packaging may vary slightly, and figures such as battery life depend on use and settings.
- Some features depend on your phone, its operating system or the brand's app.
- Smartwatch health readings are for general wellness only, not medical diagnosis.
Pricing and availability
Prices are shown in Indian rupees and can change without notice. Stock, especially of open-box units, is limited and can sell out at any time. Delivery within India is free, and delivery to some other countries is charged at a flat ₹1,800. The total payable is shown at checkout before you pay.
Despite our care, a price, description or stock level may occasionally be shown wrongly. If this affects your order, we will contact you before going ahead, and you can choose to continue at the correct price or cancel. Any amount paid for a cancelled order will be refunded.
Orders and acceptance
Placing an order is an offer to buy the products in it. The order confirmation means we have received it; the order is accepted when we dispatch it. We may decline or cancel an order before dispatch, for example if a product is unavailable, there is a pricing or listing error, we cannot deliver to the address, or we suspect fraud or misuse. If we do, we will let you know and refund any amount you have paid.
You can cancel an order within 24 hours of placing it. If a product is delivered faulty, damaged, non-working or wrong, you can request a return or replacement within 7 days of delivery, subject to standard checks. Details are in our returns, replacement and refund policy.
Intellectual property
Content on this website, such as text and page design, belongs to IndiasBuy or to its respective owners. You may view and share pages for personal use, but not copy or reuse the content commercially without our written permission.
Brand names, logos and product names belong to their respective owners and are used only to identify products. Their use does not mean that any brand has authorised, partnered with or endorses IndiasBuy. See our Disclaimer & Trademarks page.
Limitation of liability
We work to keep the website accurate, secure and available, but cannot promise it will always be uninterrupted or error-free. To the extent permitted by law:
- we are not liable for indirect or consequential losses, such as loss of data or profit, arising from your use of the website; and
- our total liability for any claim relating to an order is limited to the amount you paid for that order.
Nothing in these terms limits any liability that cannot be limited under Indian law, or your rights as a consumer, including under the Consumer Protection Act, 2019.
Governing law and jurisdiction
These terms are governed by the laws of India. Subject to your rights under consumer protection law, the courts at Delhi will have jurisdiction over any dispute arising from them. Before taking formal action, please give us a chance to resolve the issue through our grievance redressal process.
Changes to these terms
We may update these terms from time to time. The version on this page applies from when it is published, and using the website after a change means you accept the updated terms.
